What was issued in 2026 is not a ban on the product but a regulation of the sales channel and of the product itself: a Ministry of Commerce decision prohibiting sales through delivery platforms and digital means, and a Ministry of Health decision imposing a minimum age, mandatory registration and packaging restrictions, effective from the start of 2027.
The common confusion is that people hear the word “ban” and conclude the product is prohibited. The reality is different: the product is on the shelves. What changed is how it reaches you and under what conditions it is sold. That distinction matters, because it determines what you can and cannot do.
MOCI Decision No. 27 of 2026
The text of the prohibition and its scope
In force since 15 March 2026. Article One prohibits the sale of tobacco, its derivatives and cigarettes of all kinds — including electronic cigarettes and the tools, devices and accessories used to consume them — through delivery platforms or any comparable digital means.
Three observations on the text:
- The product scope is broad. It is not limited to electronic cigarettes; it covers devices and accessories too — meaning coils, pods and tanks fall under the same rule.
- The prohibited act is “selling”. The text addresses selling through delivery platforms; it does not mention any prohibition on displaying a product, describing it, or answering a question about whether it is in stock.
- The phrase “or any comparable digital means” is broad. This is the most consequential point in practice: it is open to wide interpretation, which is why most Kuwaiti retailers took the cautious route and rewrote their copy around branch collection.

What it means for shops and for buyers

MoH Decision No. 237 of 2026
Issued 12 August 2026, effective 1 January 2027. This decision runs deeper than the first, because it touches the product rather than its sales channel.
Age 21 and Civil ID verification
The minimum purchase age is 21, with Civil ID verification at the point of sale. In practice: carry your ID, and expect the request to become routine on every purchase regardless of how old you look.
Product registration with the Ministry
Every product placed on the market must be registered with the Ministry. The expected effect on the shelves: some unregistered products will be withdrawn, and the number of available brands may contract temporarily until registration is completed. The decision explicitly prohibits unregistered nicotine pouches.
Packaging restrictions and health warnings
- A ban on packaging designed to appeal to children — covering designs, colours and certain flavour names.
- Health warnings covering 50% of the pack face.
So the products on the shelf will genuinely look different from early 2027: more space given to the warning, quieter designs, and possibly amended flavour names.
The advertising and promotion ban
The decision prohibits advertising and promotion in all its forms, including influencer marketing. The practical effect: promotional content will visibly thin out and informational content will grow — which frankly serves the buyer, because an article that explains and compares is more useful than an advert that praises.
School distance and public places
The decision prohibits sales within 200 metres of schools. As for use in public places, the practical rule today is simple: follow the venue’s own signage and the rules applied to tobacco generally — malls, restaurants, government facilities and the airport each publish their own instructions, and those are the reference on their premises.
